REGULATIONS FOR THE PROVISION OF ELECTRONIC SERVICES, TICKET SALES AND PARTICIPATION IN EVENTS
- I. General provisions
- Whenever the following capitalized terms are used in the remainder of these Regulations, they shall be understood in the following sense, unless the context clearly indicates otherwise:
1.1. "Regulations" – these regulations specifying the rules for the provision and use of services offered by the Administrator via the Website, the rules for concluding contracts and purchasing Tickets, as well as the rules for participation in Events. In the scope of services provided electronically, the Regulations are the regulations referred to in Article 8 of the Act of 18 July 2002 on the provision of services by electronic means;
1.2. „Administrator” – ONDANCE EVENTS SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ with its registered office in Warsaw, ul. Szczęsna 26, 02-454 Warsaw, Poland, entered into the register of entrepreneurs of the National Court Register under the KRS number: 0000903415, NIP: 5223203694, REGON: 389090680, with the share capital of PLN 5 000.00, e-mail: contact@unicobachata.com;
1.3. „Contact Details” – e-mail address: contact@unicobachata.com, telephone number: +48 733 809 816 and correspondence address: ul. Szczęsna 26, 02-454 Warsaw;
1.4. "Website" – the website located at https://www.unicobachata.com/ together with its subpages and the purchasing mechanism;
1.5. "User" – any natural person, legal person or organizational unit using the Website, placing an Order or concluding an agreement with the Administrator;
1.6. "Consumer" – a User who is a natural person and who enters into a legal transaction with the Administrator that is not directly related to his or her business or professional activity;
1.7. "Entrepreneur with consumer rights" – a natural person concluding an agreement with the Administrator directly related to his/her business activity, if the content of this agreement indicates that it is not of a professional nature for this person, resulting in particular from the subject of the business activity performed;
1.8. "Buyer" – a User placing an Order and concluding an agreement with the Administrator regarding one or more Tickets purchased for themselves or for Participants indicated by them;
1.9. "Participant" – a natural person designated by the Buyer as the person authorized to use a specific Ticket and participate in the Event, or a person authorized to participate based on an invitation or agreement with the Administrator. The Buyer may also be a Participant;
1.10. "Services" – services provided by the Administrator via the Website, in particular providing content, forms, the Newsletter and the possibility of purchasing Tickets;
1.11. "Newsletter" – a service of periodically sending messages containing information about the Administrator's offer, organized Events and promotional campaigns;
1.12. "Event" – a training, dance, sports, artistic or integration event organised by the Administrator, taking place at a designated location, date or period;
1.13. "Social" – a separate block of the Event program including the Evening Dance Practice and the educational, sports or artistic elements assigned to it, in particular classes, a competition or shows;
1.14. "Evening Dance Practice" – part of the program intended for independent or group practice, consolidation and development of dance techniques learned during the Event or the Participant's previous dance education;
1.15. "Ticket" – personalized confirmation of the conclusion of the agreement and the entitlement of a designated Participant to participate in a specific Event or part of its program, transmitted in particular as a QR code, email, electronic document, entry on the Participant list, or wristband. One Ticket entitles one Participant to participation, unless the Ticket description clearly states otherwise;
1.16. "Order" – a declaration of intent of the Buyer submitted via the purchasing mechanism available on the Website, including in particular the selection of a Ticket, adding it to the basket, completing the order form and using the "Buy and pay" button or another equivalent button;
1.17. "Discount Coupon" – a code or other designation entitling one to a price reduction under the terms specified by the Administrator;
1.18. "Payment Operator" – an external entity handling payments made on the Website, which may also offer the Buyer deferred payment, payment by installments or other forms of financing based on a separate agreement;
1.19. "Competition Rules" – a document specifying the detailed rules of a specific competition, including the categories, conduct, evaluation criteria, scoring and the method of selecting the results.
1.20. "Force Majeure" – an external event beyond the Administrator's control, which the Administrator, acting with due diligence, could not have foreseen or whose consequences could not have been prevented, preventing or significantly hindering the implementation of the Event, in particular a natural disaster, fire, flood, epidemic, warfare, act of terrorism, riots, nationwide or industry-wide strike, infrastructure failure, long-term power outage, closure of a facility, decision of a competent authority or the introduction of legal restrictions preventing the implementation of the Event.
1.21. "Instructor-Artist" – a person conducting classes, workshops, shows, competitions or other elements of the Event program on the basis of an agreement concluded with the Administrator; - The Regulations are made available to the User free of charge, before concluding the contract, in a manner enabling their reproduction and recording.
- Each User is obliged to read the Regulations before using paid Services or placing an Order.
- Acceptance of the Terms and Conditions occurs by checking the appropriate box on the form. A contract requiring payment is concluded by clicking the button marked "Purchase and pay," "Order with obligation to pay," or another equivalent and unambiguous wording.
- Checking the box regarding the Newsletter, marketing or use of the image to the extent that separate consent is required cannot be implicitly linked to acceptance of the Regulations.
- II. Type and scope of services provided
- The Regulations apply to the following Services:
1.1. the ability to read the content posted on the Website;
1.2. the possibility of registering and purchasing Tickets for Events;
1.3. processing Orders, payments and Tickets;
1.4. Newsletter services;
1.5. Possibility of sending inquiries, notifications and complaints. - Use of the Website content is free of charge, except for clearly marked paid services.
- Participation in Events is subject to payment, unless the Administrator expressly decides otherwise.
- The price of the Ticket and the scope of services covered by the Ticket are provided before placing the Order.
- III. Technical requirements
- To use the Website, you must:
1.1. a device with Internet access;
1.2. an up-to-date web browser that supports JavaScript and cookies;
1.3. active e-mail address;
1.4. a program enabling the reading of standard electronic documents, if such documents are provided to the User. - The user should protect access data to his/her account and e-mail from unauthorized persons.
- The Administrator is not responsible for technical problems resulting solely from the User's failure to meet the requirements specified in this paragraph.
- IV. Rules for placing orders and concluding contracts
- In order to purchase a Ticket, the Buyer should:
1.1. select the Event and the appropriate Ticket type;
1.2. add the Ticket to your cart;
1.3. check the correctness of the basket contents and proceed to the order form;
1.4. complete all fields marked as required;
1.5. indicate the name and surname of the Participant assigned to each Ticket;
1.6. check the accuracy of the data provided, the type of Ticket, the number of Tickets and the total price;
1.7. read the Regulations and accept their content;
1.8. select an available payment method;
1.9. use the "Buy and pay" button or another equivalent button clearly informing about the obligation to pay;
1.10. make the payment in accordance with the instructions displayed on the Website or on the Payment Operator's website. - The Buyer is obliged to provide true, current and complete data.
- Within one Order, the Buyer may purchase Tickets for himself and for other Participants.
- In the event of purchasing more than one Ticket, the Buyer is obliged to indicate separately the name and surname of the Participant assigned to each Ticket and other data required in the Order form.
- Buyers purchasing Tickets for other people:
5.1. confirms that the data of the indicated Participants are true and have been provided with their knowledge;
5.2. undertakes to provide each Participant with the Regulations, Privacy Policy, organizational information and the Ticket intended for that person;
5.3. undertakes to inform Participants about the obligation to read the Regulations before entering the Event;
5.4. is responsible for any errors in Participant data resulting from the provision of false, outdated or incomplete information. - The Buyer is not entitled to submit on behalf of another adult Participant any declarations or consents which, according to the law, should be given personally by that Participant, in particular consent to the use of his or her individual image.
- Placing an Order constitutes an offer to conclude a contract regarding the Tickets and services covered by the Order.
- The contract is concluded when the Administrator sends the Buyer a message confirming acceptance of the Order for execution, unless the description of the sales process clearly indicates a different moment of conclusion of the contract.
- The condition for the execution of the Order is the effective execution or confirmation of the payment by the Payment Operator.
- Ticket availability is based on inventory levels visible on the Website. Once a Ticket type is depleted, it cannot be added to the cart or purchased.
- If, due to a technical error, simultaneous Order submissions, or incorrect inventory synchronization, an Order is accepted for a Ticket whose stock has already been exhausted, the Administrator will immediately notify the Buyer and refund the payment received. With the Buyer's express consent, the Administrator may offer another available Ticket type instead of a refund.
- The ticket is sent to the email address provided by the Buyer or assigned to their account on the Website. The ticket may take the form of a QR code, an electronic document, an entry on the Participant list, or other confirmation.
- All Tickets purchased within a single Order may be sent to the Buyer's email address. The Buyer is responsible for delivering individual Tickets to the appropriate Participants.
- The Buyer is obligated to check the confirmation received, particularly the Ticket type, Event date, and Participant details. Any errors must be reported without undue delay.
- Each Participant is required to read the Rules and Regulations before entering the Event. Presenting a Ticket, accepting a wristband or ID badge, and entering the Event grounds constitutes confirmation that they have read the Rules and Regulations and agree to abide by them.
- Information regarding the Order, Tickets, changes to the program, place or date of the Event may be sent to the e-mail address provided by the Buyer in the Order.
- The Buyer is obliged to regularly check the provided mailbox, including the junk mail folder, and provide information regarding the Event to other Participants covered by his Order.
- The Buyer is obliged to immediately inform the Administrator of any change in e-mail address or any error found in the contact details.
- If a Participant does not accept the Terms and Conditions, they should refrain from using the Ticket and contact the Buyer. Failure to accept the Terms and Conditions by the Participant does not automatically entitle them to a refund of the Ticket price.
- V. Prices and Payments
- The prices indicated on the Website are gross prices, unless applicable regulations allow for a different designation and such a designation has been expressly used.
- The final price of the Ticket, including taxes and mandatory fees, is provided to the Buyer before placing the Order.
- The price may depend on the sales threshold, purchase date, Ticket variant, or program scope. The price of a purchased and paid Ticket remains unchanged, except as expressly provided for by law or agreed upon with the Buyer.
- The Administrator may conduct temporary promotional campaigns and use Discount Coupons. Promotion terms may specify restrictions on the number of Tickets, the validity period, the ability to combine promotions, and changes to Participant data.
- Available payment methods are indicated on each Website. Electronic payments are processed by the Payment Operator.
- If the Payment Operator provides the Buyer with the option of deferred payment, installment payment or other form of financing, its use shall be based on a separate agreement concluded directly between the Buyer and the Payment Operator or the financing institution indicated by him.
- The Administrator is not a party to the agreement regarding deferred payment, installment payment or any other form of financing offered by the Payment Operator and does not determine the dates, amounts or number of installments.
- The obligation to repay installments or other amounts due under the financing is borne by the Buyer towards the Payment Operator or financing institution, in accordance with the terms of the agreement concluded with it.
- If the Payment Operator confirms to the Administrator that payment for the entire Order has been successfully made or guaranteed, the Order is deemed to have been paid, regardless of the dates of subsequent settlements between the Buyer and the Payment Operator.
- If a single Order includes Tickets for multiple Participants, the agreement regarding financing the entire Order is concluded by the Buyer. Individual Participants do not become debtors of the Administrator or the Payment Processor.
- Failure to timely repay the amount due to the Payment Operator does not automatically invalidate the Tickets if the Administrator has received confirmation of effective payment, unless the Payment Operator legally withdraws the transaction confirmation or the funds are not transferred to the Administrator.
- The Administrator is not responsible for the refusal to grant financing, the assessment of payment capacity, the repayment schedule, the costs charged or any actions taken by the Payment Operator or the financing institution.
- Failure to successfully complete payment or confirm payment may result in the Order being cancelled.
- At the Buyer's request, the Administrator issues an invoice in accordance with applicable regulations and based on the data provided by the Buyer.
- VI. Tickets and changing Participant details
- All Tickets sold via the Website are personal.
- Each Ticket entitles only one Participant indicated by name and surname to participate and only in the Event or part of the program specified in the Ticket description.
- Within a single Order, the Buyer may purchase Tickets for multiple Participants. Each Ticket is assigned to a separate person indicated on the Order form.
- The Buyer is obligated to assign the Participant's correct first and last name to each Ticket. Entering the same information on multiple Tickets intended for different individuals is prohibited.
- The rights arising from a specific Ticket are only available to the Participant indicated on that Ticket.
- Upon entry, the Administrator may request the Ticket and a document confirming the Participant's identity. This document is presented for inspection only.
- The QR code or other Ticket marking may be used only once, unless the Ticket type allows for multiple entries to individual parts of the program.
- Buyers and Participants should not share the QR code or any other Ticket marking with unauthorized persons. The Administrator is not responsible for the use of the Ticket by a third party if this is due to the culpable disclosure of the code by the Buyer or Participant.
- After Ticket verification, the Participant may receive a wristband or ID. Participants must wear them while at the Event and present them upon request.
- The Administrator may deny access to part of the program to a person who does not have the appropriate Ticket, wristband or ID or uses a Ticket that is invalid, counterfeit, previously used or issued to another person.
- The Participant’s data on the Ticket may be changed after obtaining the consent of the Administrator:
11.1. earlier than 45 days before the start of the Event – no fee;
11.2. from 45 to 15 days before the start of the Event – for an administrative fee of PLN 50;
11.3. later than 15 days before the start of the Event – changing the data is not possible unless the Administrator gives consent due to special circumstances. - The data on the Ticket can only be changed once.
- Tickets purchased under Blind Pass offers, special offers or promotions may not be subject to data change if this restriction was clearly indicated before purchase.
- The Administrator may refuse to change data if the restrictions result from the type of Ticket, security, the nature of the program, exhaustion of the limit of a specific participation category or the rules of the promotion.
- In the case of discounted or partner Tickets, Tickets intended for show performers or other special groups, the Administrator may request a document confirming entitlement to a given Ticket variant.
- Anyone who fails to confirm entitlement to a discounted or special Ticket may be required to pay the difference in price to the actual Ticket. Failure to pay the difference may result in the Administrator refusing admission.
- The refund, if any, is made to the Buyer who paid for the Order, and not to individual Participants, unless the Administrator agrees otherwise with the Buyer.
- VII. No statutory right to withdraw from the purchase of a Ticket
- The Ticket entitles you to participate in the Event taking place on the specified date or period indicated in its description.
- Pursuant to art. 38 sec. 1 item 12 of the Act of 30 May 2014 on consumer rights, the Consumer does not have the statutory right to withdraw from a distance contract within 14 days if the subject of the contract is the provision of services related to leisure, sporting or cultural events, and the contract specifies the day or period of service provision.
- Therefore, the purchase of a Ticket for an Event taking place on a specifically designated date is binding from the moment of conclusion of the contract, provided that the contract meets the conditions specified in paragraph 2.
- The principle set out in paragraph 3 applies regardless of whether the Ticket was provided as a QR code, e-mail, electronic document, entry on the list of Participants or other confirmation of eligibility to participate.
- The lack of a statutory right to withdraw from the contract does not exclude the right to make a complaint or the rights of the Buyer in the event of the cancellation of the Event, a change of its date or non-performance or improper performance of the contract by the Administrator.
- Inability to participate due to reasons related to the Purchaser or Participant, in particular illness, change of plans, professional obligations, problems with transport or accommodation, does not constitute grounds for a refund of the Ticket price.
- The Administrator may voluntarily agree to a refund, exchange, or transfer of a Ticket to another person. Each such case may be considered individually and does not create an obligation to apply the same solution in other cases.
- VIII. Cancellation, change of date or program of the Event
- The Administrator may cancel the Event or change its date due to Force Majeure, decisions of competent authorities, security threats, unavailability of the facility, illness of key persons implementing the program or other significant reasons beyond the Administrator's control.
- In the event of the Event being cancelled, the Buyer will receive a refund of the price of the unused Ticket, unless the Buyer accepts participation on another date or other alternative provision.
- If the date of the Event is changed, the Purchaser may keep the Ticket for the new date or, within the time specified in the notification, request a refund of the price of the unused Ticket.
- Refunds will generally be made using the same payment method, unless the Buyer expressly agrees to a different payment method that does not incur additional costs.
- The Administrator may make changes to the program, the order of classes, the location of the Event, the hours of individual parts of the program and the composition of the Instructor-Artists, if the changes are justified by organizational reasons, safety or circumstances beyond the Administrator's control and do not change the fundamental nature of the service.
- If the change is of a significant nature and leads to a fundamental limitation of the service covered by the Ticket, the Buyer and the Participant retain the rights arising from the applicable provisions.
- The Ticket price does not include transportation, accommodation, or other services independently arranged by the Buyer or Participant. The Administrator is not an organizer or intermediary for such services, and costs incurred by the Buyer or Participant beyond the scope of the Ticket do not constitute part of the refundable price in the event of cancellation or rescheduling of the Event.
- IX. Nature of the Event, Socials and Ticket Price Range
- The event is educational, dance-based, sporting, and artistic. Its goal is to develop participants' dance skills, impart knowledge of dance technique and methodology, and enable practical application of the elements learned.
- The Event Program may include, in particular, workshops, technical classes, artistic presentations, competitions, shows, and daytime and evening dance practices.
- The necessary conditions for the implementation of the Event include, in particular, the provision of appropriate space, organizational infrastructure and the participation of Instructor-Artists implementing the program.
- The subject of the Administrator's service is the preparation and implementation of a training and dance program, providing the venue, organizational services, infrastructure and the possibility of participating in parts of the program covered by the selected Ticket.
- Social is intended for the practical application, consolidation and development of dance techniques learned during classes held as part of the Event or during the Participant’s previous dance education.
- Friday Social may include classes led by Artist Instructors and a subsequent Evening Dance Practice.
- Saturday Gala Social may include a competition, artistic performances and an Evening Dance Practice.
- Sunday Social may include classes led by Artist Instructors and a subsequent Evening Dance Practice.
- The detailed scope of a given Social results from the current program provided by the Administrator.
- Participants can purchase a Ticket for a selected Social or a package encompassing multiple Socials. Individual Ticket options allow for the selection of program content that best suits the Participant's training needs, interests, and time availability.
- The Ticket price includes, depending on the selected variant:
11.1. preparation and organization of a given program block;
11.2. opportunity to participate in classes, competitions or shows;
11.3. the possibility of using the space intended for dance practice;
11.4. participation of Instructor-Artists, presenters, show performers or competition participants;
11.5. infrastructure, technical support, organizational support and security-related activities. - The Ticket price is not dependent on the use of specific songs, recordings, repertoire or a specific type of sound layer.
- The Administrator does not sell access to specific songs, recordings, or repertoire. No portion of the Ticket price is separately charged or collected for access to specific songs or recordings.
- The audio layer does not constitute a separate benefit offered to the Participant and is not a guaranteed element of the Ticket.
- The absence, change, limitation or interruption of the audio layer does not constitute an independent basis for the refund of the Ticket price if the Administrator ensures the possibility of participating in the essential elements of the program covered by the Ticket.
- The training program can also be implemented using rhythm and beat calculations, voice commands, movement demonstrations and other training methods.
- The purchase of a Ticket does not transfer to the Buyer or Participant or grant them rights to works, artistic performances, phonograms, videograms, training materials or other content used during the Event.
- The number of people who can participate in individual classes, shows, competitions and other parts of the program at the same time may be limited due to room capacity, safety, comfort of Participants or the requirements of the facility owner.
- If the Ticket description does not provide for a personal reservation of a place in a specific class, entry to a given part of the program is determined by the order of arrival, with priority given to the type of Ticket.
- A ticket providing access to multiple parts of the program does not guarantee the possibility of participating in all classes simultaneously, especially if they are held at the same time or the number of places in the room has been reached.
- Reaching the maximum number of people allowed in the room entitles the Administrator to temporarily suspend access. This does not constitute a breach of contract if the Participant can use the remaining parts of the program covered by the Ticket and the restriction was introduced for safety or capacity reasons.
- Participation in classes conducted in pairs does not require a permanent partner, unless the description of a specific class clearly states otherwise.
- Partner rotation may be mandatory during classes. Participants may refuse to change partners, but should be aware that this may limit their ability to complete some exercises.
- The Administrator takes steps to maintain the appropriate proportions of dance roles, but does not guarantee each Participant a permanent partner or a perfectly equal number of people in individual roles.
- In order to maintain the appropriate balance of dance roles, safety, and quality of classes, the Administrator may temporarily limit or suspend the sale of certain types of Tickets. This restriction applies to the role performed during the class, not the Participant's gender.
- The participant should choose classes that correspond to his or her actual skills, in accordance with the level indicated in the program or class description.
- For safety or substantive reasons, the Instructor-Artist may recommend that the Participant participate in other classes if the level of the selected classes is clearly not suited to his/her skills.
- If a Participant's continued participation in a specific activity poses a real risk to themselves or others, the Instructor-Artist may terminate their participation and designate a safer portion of the program. This decision does not automatically terminate the Participant's access to the entire Event.
- X. Rules of participation and safety
- The participant is obliged to:
1.1. comply with the Regulations, rules in force at the facility and lawful instructions of the Administrator, staff, security and managers;
1.2. behave in a manner that does not endanger the safety, health, dignity or property of other people;
1.3. refrain from aggression, threats, harassment, violence, discrimination, persistent disruption of the program and violation of the boundaries of other Participants;
1.4. use the equipment and infrastructure in accordance with their intended purpose;
1.5. immediately report any hazards, accidents, damage or other dangerous situations to the staff;
1.6. comply with the ban on smoking, electronic cigarettes and the use of open flames outside places expressly designated for this purpose;
1.7. not to bring dangerous items or substances prohibited by law;
1.8. take care of personal hygiene and wear appropriate attire for safe participation in classes and dance practices. - Participation in the Event under the influence of narcotics, psychotropic substances or other substances that impair the ability to behave safely is prohibited.
- Merely consuming alcohol in a legally permitted location does not result in automatic exclusion. However, the Event Administrator may refuse entry or order the departure of any person whose condition or behavior indicates a lack of control, aggression, disorderly conduct, or a threat to themselves or others.
- Before starting the activity, the participant should assess their health condition and adjust the intensity of participation to their capabilities.
- The participant should inform the instructor about any injury, poor health or health restrictions if this information is necessary to ensure safety during the class.
- Participation in dance activities involves the usual risks of physical exertion, including the possibility of abrasions, bruises, strains, or injuries. This provision does not exclude the Administrator's liability in cases where it cannot be excluded by law.
- Participants should secure their personal belongings and not leave valuables unattended. The Administrator is responsible for any loss or damage to items only to the extent permitted by applicable regulations or by acceptance of items for safekeeping.
- The Participant should arrive at the class well in advance to allow for Ticket verification, leaving outerwear, changing footwear and safely starting the activity.
- The Instructor-Artist or staff may refuse to admit a late Participant to a specific class if his or her entry could disrupt the course of the class, affect the comfort of other people or pose a threat due to omitting the warm-up or safety instructions.
- Refusal to enter a specific activity due to significant delay by the Participant does not automatically entitle the Participant to a refund of all or part of the Ticket price if the Participant retains access to the remaining parts of the program covered by the Ticket.
- The Participant may stay at the Event venue only on the days and at the times and in the parts of the facility covered by the Ticket held.
- It is forbidden to enter technical rooms, warehouses, dressing rooms, areas intended for Instructor-Artists, employee rooms, organizational areas and other places marked as inaccessible to Participants without the consent of the Administrator.
- The Participant is obliged to follow the safety and movement rules within the facility provided by the Administrator or the owner of the facility, provided that they have been made available to him or her and are not contrary to the Regulations or applicable regulations.
- A person who has entered an inaccessible part of the facility, refuses to leave it or is on the Event premises beyond the scope specified in the Ticket may be requested to immediately leave that space or the entire Event.
- XI. Refusal of entry and removal of a Participant
- The Administrator may refuse entry or order a person to leave the Event if:
1.1. does not have a valid Ticket, wristband, ID badge or invitation;
1.2. uses a Ticket belonging to another person or a Ticket that is counterfeit, invalidated or previously used;
1.3. is in a state indicating intoxication or the influence of intoxicating substances to an extent that may affect safety or order;
1.4. behaves aggressively, threatens other people, violates their privacy, harasses them or persistently exceeds their boundaries;
1.5. smokes outside the designated area or uses open fire in an unauthorized manner;
1.6. possesses dangerous items, prohibited substances or clothing or clothing elements that pose a real threat;
1.7. destroys property or disrupts a class, competition, show or any other part of the program;
1.8. engages in unauthorized recording, photographing, transmitting or disseminating of materials;
1.9. refuses to obey a lawful order relating to safety or order;
1.10. otherwise materially violates the Regulations or applicable regulations;
1.11. without the consent of the Administrator enters rooms or areas inaccessible to Participants or refuses to leave them. - Before applying the measure indicated in paragraph 1, the Administrator may, if the nature of the situation allows it, request the Participant to cease the infringement.
- In the event of an immediate threat, aggression, serious violation of other people's boundaries, destruction of property or suspicion of committing a prohibited act, the Administrator may take immediate action, call security, the Police, an ambulance or other appropriate services.
- A person removed from the Event due to a material breach of the Regulations shall not be entitled to a refund for the used or unused part of the Ticket, unless mandatory provisions provide otherwise.
- The Administrator may, before the start of the Event, refuse participation to a person whose previous, properly documented behavior during the Administrator's Events or similar events indicates a real risk to the safety, order, property, good name of the Administrator or the rights of other persons.
- In the event of refusal referred to in paragraph 5, after the prior purchase of the Ticket, the Administrator shall refund the price of the unused Ticket to the Buyer.
- A decision to refuse entry or participation cannot be based solely on the Participant's gender, gender identity, orientation, origin, disability, religion, lawful appearance, manner of dress or other legally protected characteristic.
- A Participant’s unusual manner of dress or expression may justify intervention only if it involves an actual violation of the law, safety, smoking ban, disruption of the program, harassment of other persons or other specific violation of the Rules.
- XII. Liability for damages and intervention costs
- The Participant is liable for any damage caused to the Administrator, the owner of the facility, another Participant or a third party under the terms of applicable regulations.
- In the event of culpable destruction, damage, contamination or loss of property, the Participant may be required to cover documented and justified costs of repair, replacement, cleaning or restoration of the property to its previous condition.
- If the Participant's culpable or unlawful conduct results in the intervention of security, the Police, fire brigade, ambulance or other services, the Participant may be liable for documented damage and reasonable costs that are in a normal causal relationship with his or her conduct.
- The mere presence or intervention of law enforcement agencies does not automatically create an obligation for the Participant to pay. Liability requires a legal basis, culpable conduct, damage or expense, and a causal link.
- The Participant is also liable for justified claims of third parties, penalties or costs imposed on the Administrator if they are directly related to the Participant's culpable and unlawful conduct and the obligation to cover them results from legal provisions.
- The Administrator may document the event in particular by means of a report, photographs, monitoring recordings, witness statements, bills, invoices, cost estimates or documentation provided by the owner of the facility or the relevant services.
- The participant has the right to receive information on the basis and method of determining the claimed amount and to present his/her position.
- XIII. Photographing, filming and recording the Event by the Administrator
- The course of the Event may be recorded by the Administrator and persons acting under his authorization using photographs and video recordings.
- Registration can be used to:
2.1. documenting the course of the Event;
2.2. preparing a report from the Event;
2.3. promotion of current and future Administrator Events;
2.4. running the Website and the Administrator's official profiles on social media;
2.5. production of materials ordered by Participants, Instructor-Artists, performers or partners;
2.6. ensuring security and determining the course of incidents, provided that the registration is carried out in accordance with the law and appropriate information on data processing. - The Participant acknowledges that official photographers and videographers may be working during the Event and that he or she may be recorded as part of a wider frame, group, audience, room, class or other entity.
- The image of a Participant constituting only a detail of a larger whole may be disseminated within the limits permitted by applicable regulations.
- If the Participant does not wish to be recorded, he/she should inform the photographer, cameraman or staff as soon as possible, avoid posing, marked recording areas, group photos and the place directly in front of the lens and – if possible without disrupting the programme – remove himself/herself from the frame.
- The Administrator will take reasonable steps to take into account the application referred to in paragraph 5. This provision does not limit the Participant's rights under the provisions on the protection of image and personal data.
- Publication of material in which the Participant is the main, individually recognizable element of the frame requires the Participant's consent, unless a statutory exception applies.
- Permission for individual use of the image may be granted in a separate declaration, during the Participant's registration, before the material is made or by consciously posing for the designated material, if the circumstances do not raise doubts as to the scope of the permission.
- Refusal to grant general marketing consent for individual encounters does not exclude the possibility of participating in regular parts of the Event.
- To the extent that image processing is based on consent, the Participant may withdraw it for the future by contacting the Administrator. Withdrawal of consent does not affect the lawfulness of actions taken prior to its withdrawal.
- A participant who registers to participate in a competition or show acknowledges that the recording and reporting of his or her performance is related to the public presentation that constitutes the essence of this part of the program.
- By entering a competition or show and accepting the Regulations, the Participant allows the Administrator to record his/her performance free of charge and to disseminate his/her image recorded in connection with this performance, for the purpose of documenting, reporting and promoting the Event and the Administrator's activities, in particular on the Website, official social media profiles, information, advertising and archival materials of the Administrator.
- The permission indicated in paragraph 12 covers the use of photographs and video recordings, their cropping, shortening, editing and combining with the Event designation, provided that the use does not violate the dignity or personal rights of the Participant and does not present him or her in an offensive or misleading context.
- In the case of a minor, the consent required by law is granted by the legal representative.
- Detailed information on the principles of processing image and other personal data is specified in the Privacy Policy.
- The Administrator does not conduct continuous audio recording as part of security monitoring unless there is a separate legal basis and the individuals covered by the recording have been properly informed of it. Video recordings prepared as program coverage may contain audio that is an integral part of the recorded material.
- XIV. Prohibition of recording and protection of event materials
- Without the prior consent of the Administrator, it is prohibited to photograph, film, record sound, conduct live broadcasts or perform any other forms of recording the Event by Participants and third parties.
- The prohibition covers in particular:
2.1. recording all or significant parts of classes, shows, competitions and dance practices;
2.2. recording Instructor-Artists, jurors, performers, competition participants and other Participants;
2.3. recording of full songs, sets, recordings, artistic performances or sound layers;
2.4. photographing or copying training materials, presentations, screens, organizational documentation or results prior to their official announcement;
2.5. publishing broadcasts or materials from the Event for commercial, promotional or competitive purposes. - A person intending to appear at the Event with a professional or semi-professional camera, camcorder, recorder, microphone, tripod, additional lighting or similar equipment should inform the Administrator of this before the Event and obtain his consent.
- Consent should specify the scope of permitted registration, the intended use of the material, and the terms of its publication. Failure to respond from the Administrator does not constitute consent.
- The prohibition does not apply to an official photographer, video operator, employee, associate or other person authorized by the Administrator.
- The person with consent is obliged to respect image rights, privacy rights, copyright and related rights and to follow the instructions of the staff.
- The Administrator may order the immediate cessation of unauthorized recording, secure the equipment to prevent further registration, or leave the Event. In cases permitted by law, the Administrator may seek the removal of unlawfully recorded or distributed materials and compensation for any damage.
- Unauthorised registration may constitute grounds for refusing entry or removing the Participant without refund of the Ticket price, subject to mandatory provisions.
- Training materials, presentations, graphics, photographs, recordings, markings, scripts, original choreographies, exercise descriptions and other content made available during the Event may be subject to protection under the provisions on copyright, related rights, trademarks or the protection of personal rights.
- Purchasing a Ticket entitles you to personal participation in the program only. It does not transfer any rights or grant any license to copy, distribute, make available for payment, or use protected materials for professional or commercial purposes.
- Without the consent of the authorized person, it is prohibited to copy and distribute materials provided to the Participant or to use protected content to create your own paid courses, publications, recordings or promotional materials.
- The provisions of this paragraph do not limit permitted use or other rights arising directly from applicable law.
- XV. Competitions and shows
- Competitions organised as part of the Event are of a dance, sports, artistic or training nature.
- Participation in the competition requires:
2.1. possession of an appropriate Ticket or making a separate application;
2.2. meeting the conditions for the competition category;
2.3. acceptance of the Regulations and the relevant Competition Rules;
2.4. appear at the place and time indicated by the Administrator;
2.5. participate in the organizational briefing, if provided. - Detailed rules of the competition, in particular the categories, system of rounds, composition or rules for appointing the jury, evaluation criteria, scoring, qualification procedure, rules for resolving ties and prizes, are specified in the Competition Rules.
- The Competition Rules should be made available to Participants prior to the start of the Competition in a manner that allows them to familiarize themselves with them. During the briefing, the Administrator may explain the technical and organizational rules, but should not introduce unfavorable, significant changes without providing Participants with an opportunity to familiarize themselves with them.
- The participant is obliged to follow the instructions of the leaders and staff regarding the order of starts, safety and organization of the competition space.
- Behaviour that endangers a partner, other competitors, jurors, the audience or staff, as well as deliberately obstructing the performance of other people, is prohibited.
- The Administrator may not allow a Participant to start or interrupt his or her participation if his or her health, psychophysical condition, behavior, clothing, footwear or props used pose a real threat.
- The Administrator may issue a warning, deduct points, prevent the Participant from progressing to the next stage or disqualify him/her if the Participant:
8.1. violates safety rules;
8.2. deliberately obstructs another person's performance;
8.3. behaves aggressively or in an unsportsmanlike manner;
8.4. provides false information regarding the fulfillment of the conditions of participation;
8.5. violates the Competition Rules or fails to follow organizational instructions;
8.6. attempts to influence the jurors' assessment in a manner contrary to the competition rules. - Disqualification resulting from a culpable violation of the rules by the Participant does not entitle the Participant to a refund of the Ticket price or the competition fee.
- The jury's artistic and sporting assessments are discretionary within the criteria specified in the Competition Rules.
- The jury's decisions regarding artistic or technical evaluation are final. This does not exclude the possibility of filing a complaint regarding procedural violations, calculation errors, or non-compliance with the published rules.
- The Administrator may document the results, publish the names and surnames or nicknames of the finalists and winners, as well as materials from their performances under the terms and conditions set out in the Regulations and Privacy Policy.
- XVI. Newsletter
- The Newsletter subscription agreement is concluded for an indefinite period.
- The Newsletter may be used by any person who provides a correct and current e-mail address and expresses the legally required consent to receive marketing information.
- Consent to the Newsletter is voluntary and is not a condition for purchasing a Ticket or participating in the Event.
- The User may unsubscribe from the Newsletter at any time by using the unsubscribe link in the message or by sending a request to contact@unicobachata.com.
- Unsubscribing from the Newsletter has future effect and does not involve any fees.
- The Administrator may terminate the provision of the Newsletter after informing Users if this is justified by the cessation of service provision, technical or legal changes.
- XVII. Rights and obligations of Users
- It is prohibited for the User to provide illegal content that violates the rights of third parties, good customs or safety rules.
- It is prohibited to take any action that may disrupt the functioning of the Website, forms, sales system, payment system or Newsletter.
- The User undertakes not to provide access data to the account to unauthorized persons.
- The user is responsible for the accuracy, currency and completeness of the data provided.
- In the event of a violation of the Regulations causing damage to the Administrator, the User is obliged to repair it in accordance with the principles arising from applicable regulations.
- The User may report to the Administrator any violation of the Regulations, law, safety or good manners at contact@unicobachata.com.
- XVIII. Responsibility of the Administrator and operation of the Website
- The Administrator takes appropriate actions to ensure the proper and safe functioning of the Website.
- The Administrator is not liable for temporary disruptions resulting from force majeure, failures of infrastructure providers, unauthorized actions of third parties or technical work, to the extent that such circumstances are beyond its control.
- The Administrator may temporarily interrupt the operation of the Website for maintenance, updating or to remove security threats.
- The limitations of liability set out in the Regulations do not apply to damage caused intentionally or to liability that cannot be excluded under mandatory provisions.
- XIX. Complaints
- The User may submit a complaint regarding the functioning of the Website, Order, payment, Ticket or performance of the contract.
- Complaints can be sent:
2.1. to the e-mail address contact@unicobachata.com, entering "Complaint" in the subject line;
2.2. in writing to the following address: ul. Szczęsna 26, 02-454 Warsaw. - The complaint should include, if necessary for its consideration:
3.1. name and surname;
3.2. e-mail address used for the Order;
3.3. Order or Ticket number;
3.4. description of the problem and date of the incident;
3.5. User request. - The lack of data that is not necessary to determine the subject of the complaint does not result in automatic rejection of the complaint.
- The Administrator will respond to the Consumer's complaint within 14 days of receiving it, unless a specific provision provides for a different deadline.
- The response will be sent on paper or another durable medium, in particular to the e-mail address provided by the User.
- The complaints procedure does not exclude the right to pursue claims in court.
- XX. Personal data
- The controller of personal data processed in connection with the use of the Website, purchase of Tickets and participation in Events is ONDANCE EVENTS SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ.
- Personal data may be processed in particular for the following purposes:
2.1. processing Orders and payments;
2.2. issuing and redeeming Tickets;
2.3. organization of Events;
2.4. verification of entry eligibility;
2.5. handling complaints and pursuing or defending claims;
2.6. ensuring security;
2.7. conducting the Newsletter and marketing, if there is an appropriate legal basis;
2.8. recording and publishing materials from the Event in accordance with the principles set out in the Regulations and Privacy Policy. - Detailed information on the legal basis, storage periods, data recipients and the rights of data subjects can be found in the Privacy Policy available on the Website.
- Providing data necessary to conclude and perform the contract is voluntary, but failure to provide it may prevent you from purchasing a Ticket or participating in the Event.
- If the Buyer purchases a Ticket for another person, the Participant's personal data is transferred to the Administrator by the Buyer in order to assign the Ticket, manage participation in the Event, verify entry eligibility and ensure the safety and proper organization of the Event.
- The Buyer is obliged to inform the indicated Participant about the transfer of his or her data to the Administrator and to make the Privacy Policy available to him or her.
- The Administrator may provide the Buyer with a message, link, or document intended for individual Participants. The Buyer is obligated to forward such information to the appropriate individuals without undue delay.
- Consents regarding the Newsletter, marketing, or use of an individual's image must be granted directly by the individual concerned. The Buyer may not grant such consent on behalf of another adult Participant.
- In the case of a minor Participant, the required declarations and consents are submitted by his or her legal representative, if required by applicable regulations.
- XXI. Final Provisions
- Agreements concluded via the Website are concluded in Polish, unless the parties agree otherwise.
- In matters not regulated by the Regulations, the generally applicable provisions of Polish law shall apply, in particular the Civil Code, the Consumer Rights Act, the Act on the provision of electronic services, personal data protection regulations and the Act on Copyright and Related Rights.
- The Administrator may change the Regulations for important reasons, in particular in the event of:
3.1. changes in legal provisions or their interpretation;
3.2. decision of a competent authority or court ruling;
3.3. changes to the scope or method of providing the Services;
3.4. changes to payment methods, Website functionality or technical requirements;
3.5. the need to increase the security of Users or protect their rights. - Amendments to the Regulations do not infringe upon acquired rights or the terms of one-off contracts concluded before the amendments entered into force, unless the amendment results from mandatory provisions.
- In the case of continuous Services, the User will be informed about changes to the Regulations in due time and will be able to terminate the contract before the change comes into effect.
